Terms of Service

Welcome to Roomza. These Terms of Service (“Terms”) govern your use of the Roomza website, mobile experience, and any related services (collectively, the “Service”) operated by Roomza, Inc. (“Roomza,” “we,” “us,” or “our”). By accessing or using Roomza, you agree to be bound by these Terms. If you don’t agree, please don’t use the Service.

Hotel partners are subject to a separate Partner Agreement entered into during onboarding. These consumer Terms do not apply to or supersede that agreement.

1. Who We Are

Roomza, Inc. is a Delaware corporation. You can reach us at support@roomza.com.

Roomza is an independent hotel room intelligence platform. We are not a booking agency, travel agent, or hotel operator. We do not take reservations. We do not guarantee availability or pricing at any property. Any booking you make is directly with the hotel or a third-party booking service.

2. Eligibility

You must be at least 13 years old to use Roomza. By using the Service you represent that you meet this requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Your Account

Creating an account is optional for browsing Roomza. Certain features — saving your Room Type, submitting reviews, and accessing personalised recommendations — require an account.

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at support@roomza.com if you believe your account has been compromised. We are not liable for losses arising from unauthorised account access where you have failed to keep your credentials secure.

You may not create an account on behalf of someone else, impersonate any person, or use a false identity. We reserve the right to suspend or terminate accounts at our sole discretion.

4. Content on Roomza

Our Content

Room descriptions, scores, narratives, editorial content, the Room Type quiz, Room vs Room game, and all other original content produced by Roomza (“Roomza Content”) are owned by Roomza, Inc. and protected by copyright. You may not reproduce, redistribute, or create derivative works from Roomza Content without our written permission.

Third-Party Content

Roomza displays hotel names, logos, photographs, and brand materials for the purpose of identification, comparison, consumer education, and commentary. All such marks and materials remain the property of their respective owners. We are not affiliated with, endorsed by, or sponsored by any hotel brand unless explicitly stated.

Your Content

If you submit a review, photo, or other content through Roomza (“User Content”), you grant Roomza a perpetual, worldwide, royalty-free, sublicensable licence to use, display, reproduce, modify, and distribute that content in connection with operating and promoting the Service. You represent that you own or have the rights to submit your User Content and that it does not violate any third-party rights or applicable law.

We reserve the right to remove User Content for any reason, including content we determine to be false, misleading, inappropriate, or in violation of these Terms.

5. Reviews & Verified Guest Program

Roomza operates a verified guest review system. Reviews are tied to confirmed reservations and submitted using a one-time verification token. By submitting a review, you confirm that:

  • You personally stayed in the room you are reviewing.
  • Your review reflects your honest, first-hand experience.
  • You have not been compensated by the hotel or any third party for a favourable review.
  • Your review does not contain false statements of fact, personal attacks, or illegal content.

Roomza reserves the right to investigate, moderate, and remove reviews. We do not guarantee that all reviews are accurate, and we are not liable for the content of user-submitted reviews.

6. Room Type Quiz & Room vs Room

The Room Type quiz and Room vs Room game are entertainment and discovery features. Your “Room Type” result is generated algorithmically based on your in-session choices and is provided for fun and guidance only. It does not constitute a professional recommendation and carries no guarantee of accuracy or suitability. Results are stored locally on your device and, if you are logged in, associated with your account.

7. Roomza Concierge

The Roomza Concierge is an AI-powered voice and text assistant available through the Roomza website, mobile app, and by phone. The Concierge can help you search for hotels, check room scores and reviews, look up pricing, find nearby places, and manage your trip details.

Voice Conversations

When you use the Concierge in voice mode, your audio is streamed to ElevenLabs, Inc. for real-time speech recognition and voice synthesis. By using the voice feature, you consent to this processing. Conversations may be recorded and analysed by ElevenLabs to improve service quality, subject to their privacy policy.

Conversation Transcripts

Text transcripts of your Concierge conversations are stored locally on your device using browser storage. You can clear your conversation history at any time from within the Concierge interface. Transcripts are not uploaded to Roomza servers.

Personalisation

When you are signed in, the Concierge has access to your name, room preferences, upcoming trips, and loyalty program memberships to provide personalised assistance. When you are not signed in, the Concierge can still help with general hotel search, scores, and pricing but cannot access personal account features.

Limitations

The Concierge is an AI assistant and may occasionally provide inaccurate or incomplete information. It does not constitute professional travel advice. The Concierge cannot make reservations or process payments on your behalf. Any special requests submitted through the Concierge are forwarded to the relevant hotel on a best-effort basis; Roomza does not guarantee that hotels will fulfil these requests.

Phone & Messaging

The Concierge is also available by phone and may be available via SMS or messaging platforms. Phone and messaging conversations are not authenticated; the Concierge cannot access your personal account data over these channels. Standard carrier rates may apply to phone calls and text messages.

8. Prohibited Conduct

You agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms.
  • Scrape, crawl, or systematically extract data from Roomza without written permission.
  • Submit false, misleading, or fraudulent reviews or information.
  • Interfere with or disrupt the Service or servers or networks connected to the Service.
  • Attempt to gain unauthorised access to any part of the Service or its related systems.
  • Use automated means to interact with the Service without our prior written consent.
  • Post or transmit any content that is defamatory, harassing, obscene, or otherwise objectionable.
  • Impersonate Roomza, any hotel, or any other person or entity.

9. Third-Party Links, Affiliate Relationships & AI Services

Roomza may contain links to third-party websites, including hotel booking pages, hotel official websites, and other services. These links are provided for your convenience. We have no control over, and assume no responsibility for, the content, privacy practices, or terms of any third-party site. Accessing a third-party site through a Roomza link is at your own risk.

Pricing, availability, and booking terms are controlled entirely by the hotels and booking platforms to which we link. Roomza makes no warranty regarding the accuracy of pricing or availability information displayed on or linked from our Service.

Affiliate Links & Commissions

Some booking links displayed on Roomza are affiliate links. This means Roomza may earn a commission if you click through to a booking platform and complete a reservation. This has no effect on the price you pay. Affiliate relationships do not influence Roomza’s room scores, editorial rankings, or review content. Where affiliate links are present, we display a disclosure near those links.

AI-Powered Features & Third-Party AI Services

Roomza uses large language model (LLM) services, including the Anthropic Claude API, Google Gemini, and ElevenLabs Conversational AI, to power features including room narratives, hotel synopses, Room of the Day content, the Roomza Concierge, booking confirmation parsing, and pre-arrival briefs. These AI-generated outputs are provided for informational and entertainment purposes only and do not constitute professional advice of any kind.

Voice interactions with the Roomza Concierge are processed by ElevenLabs, Inc. See Section 7 (Roomza Concierge) for details on voice data processing and your rights.

Roomza also participates in the Model Context Protocol (MCP) ecosystem, which allows AI assistants and agents to access structured Roomza data through standardised interfaces. Use of Roomza data through MCP-compatible tools is subject to these Terms and any applicable API or developer agreement.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ROOMZA DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Room scores, descriptions, narratives, and editorial content are based on available data and editorial judgment. They are provided for informational purposes only. Roomza does not guarantee the accuracy, completeness, or timeliness of any content on the Service.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ROOMZA, INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN NO EVENT SHALL ROOMZA’S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO ROOMZA IN THE TWELVE MONTHS PRIOR TO THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).

12. Indemnification

You agree to indemnify, defend, and hold harmless Roomza, Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your access to or use of the Service, your User Content, or your violation of these Terms.

13. Dispute Resolution & Arbitration

Please read this section carefully — it affects your legal rights.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, rather than in court. You waive your right to a jury trial and to participate in a class action.

Notwithstanding the foregoing, either party may bring an individual claim in small claims court. You have the right to opt out of arbitration within 30 days of first agreeing to these Terms by emailing us at support@roomza.com with the subject line “Arbitration Opt-Out.”

14. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law principles. Any dispute not subject to arbitration shall be resolved exclusively in the state or federal courts located in the State of Delaware, and you consent to personal jurisdiction in those courts.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we’ll update the “Last updated” date at the top of this page. If we make material changes, we’ll make reasonable efforts to notify you — for example, via email or a notice on the Service. Your continued use of Roomza after changes take effect constitutes your acceptance of the revised Terms.

16. Termination

We may suspend or terminate your access to the Service at any time, for any reason, with or without notice. All provisions of these Terms that by their nature should survive termination — including ownership, disclaimer, limitation of liability, and dispute resolution provisions — shall survive.
